H4 - must be allowed to work. American economy does not differenciate between an American and a legal alien. We all pay the same rent, same tax, same price for car. When our H4 spouses cannot work, we have to totally depend on one salary. In case of emergencies we hit rock bottom economically. Quite obviously our quality of life is compromised.
But what do we do about it?

Well depends on the job I want to get done. New Internatinal graduates come with less salary, more enthusiam, are hardworking and would go out of their way to get some work done.
In addition to that if I have a constant supply of H1Bs why would I want to spend more money on high salary & more perks if I can train newbies in 6 months.
Good luck running your company! Just imagine this, you spend 6 months training an international grad, spend $5000 - $7000 per H1B and after 1 - 2 yrs, you will have to start all over again. After a couple of months, the "new hire" will just be angry at you (just look at all the people on this forum who curse bodyshoppers - and just to clarify - I am not implying that the company you start will be a bodyshopping firm) and he will quit your company and join someone else. And you will have to start the process all over again. The guy who you hired on H1B will be now join someone else and depending on your business, you will be left high and dry.
I know this because the very first job I joined, the philosophy at the company was to hire fresh grads (the "get them cheap" works for American Grads too). My boss used to tell me "we can get two for the price of one". The year I got hired, the company recruited 15 new grads (a new "Product Development" dept. was being started) - and I was the only H1B. After 14 months, when the business started picking up, the company did not even bother to raise our pay or even recogonize us. Guess what happened? Over a period of 2 months, 12 of us quit for better jobs. Guess who now had to look for 12 people and at the sametime deliver the product to the clients on time?
And the company was not even a "desi" company. During my time there, we used to discuss the book "Good to Great" and how we could make the company a Great Company. The management used to talk about getting the "right people on the bus". I guess finally the "right people" found out that the bus was not going their way and got off it.

Another rally simultaneously in many states will have good effect provided we have min 500 numbers in individual states.
And yes since we had the DC rally on a weekday (for a geniune reason)
it would be better to make this one a weekend rally just to push things and keep the momentum going. Sure a weekend will fetch 10* more crowd than on a weekday. Sunday would be much preferred as the next day is a working day and things will hot up..!
It can be one rally per neighbouring states.. eg > tristates -- NJ, NY & PA can have one rally . MD , DC & VA can have one ..

People with EB3 applications should be allowed to port. But these should be EB3 applications which were genuinely applied and not substitute labor which opened during July 2007 fiasco.
Because a EB3 application with substitute labor in July 2007 has a priority date of 2002,2003,2004,2005 or even 2006. Where as a genuinely applied Eb2 prior to that, had the qualifications / job requirements before July 2007 and they are still waiting.
USCIS should realize their mistake in 2007, it encouraged a pay to play scheme, which is putting genuine people at great disadvantage.
Porting like any option was started with a good intention, but because of loop holes it has lost its meaning. There are people who landed in this country during the July 2007 fiasco, paid for the labor and have green cards in their hands now.
Or at least provide the same level of stringent requirements to port like (EB2-->EB1) . Technically a EB3 can port to EB1 also, but porting to EB2 is easier. That way Eb3's can consume Eb1 number and stop spill over to Eb2.
L1A is another one, where people qualify as global project managers with very minimal effort, could have less experience than a EB3 or in some cases they have reported to people in EB3 queue here from 2002 and are ahead of the EB3 within 6 months.

but if I applied for I485 in July, and 485 applications they receive exceeds the visa numbers available for July, what happens? Do they draw lottery to see which 485 apps would be cosidered?
in other words, just making sure the app reaches USCIS in july first wekk, does it guarantee EAD for spouses?

I think for Indian EB-3s, if your priority date is after March 2002, it is definitely worthwhile to do the conversion. Chinese EB-3s with priority dates after Sept. 2003 should definitely convert too.
Even considering the time to find a job, file a new labor and I-140, it still looks like that you will get your GC faster than waiting in a not-moving line. The recent history has shown that the visa bulletin can get stuck for a specfic cutoff date for half a year. Besides, EB3s have been and will always be of a lower priority just as someone said in other posts.

President drives the policy. He decides which laws are to be considered, which policy is to be formulated. He tells that to the Congress asking Congress to fix an issue. Say President wants Social Security reform, he will ask congress the kind of social security reform he wants. If a member of congress agrees, he or she will propose a law. Majority leader in the Senate and House speaker schedules the vote on the floor and they drive their "House" but the policy is driven by the President. Veto is not the only thing that a President does although in the current Presidential debate, you will hear about the macho-ism of candidates based on how many bills he/she vetoed, as if to veto a bill Governor or future President will have to lift 500 pounds for the "people's sake".
Although there is always an urge to over simplify things in real life, maybe because over-simplifying makes us looks good by suggesting easy solutions to any complex situation, maybe that’s why we want to believe that Republicans are better than Democrats or Democrats are better than republicans, easy pick problem solved. But like most things in life, the immigration debate is so convoluted and complex that any one party is not for/against any specific issue. It is very easy to find republicans who are opposed to our provisions and democrats who want us out of here.
Also, here is a reason why I opened this thread and why comments from Sen. Obama to the question of employment based green card is important. I don’t know much about ever complex politics and immigration, but I am a frequent visitor to this site and learned a lot about the issue during Durbin Grassley bill. In CIR of 2007 had provisions that were designed to eliminate AC21 and visa extension beyond 6 years. If that happens now, a lot of people who really don’t care who wins the election will be asked to leave, in most cases immediately. 2007 CIR was designed by Sen. Durbin. Sen. Durbin is also Campaign Chair for Sen. Obama. Sen. Durbin will drive President Obama’s policy on green card and H1 issue. They may intend to stop so called “exploitation”, but in the process as always is the case, they will be foolish enough to pass such provisions to punish the people that are being “exploited”, which I guess is us. And if they pass laws to abolish AC21 Section 106 (a) & (b) and if they remove 7th yr H1 extension, which at this time is tip of the ice-berg, I hope you can imagine how rest of the things will shape up. My intent of opening this thread was to find out the intensity of Sen. Obama’s reply and see if his administration will be able to withstand an onslaught from Sen. Durbin in preventing any foolish provisions that have not been thought through.
I guess now you see the relevance of the position of Sen. Obama on this issue.
And BTW, "interested in legal immigration" is a very lose term. It can mean lot of things. The writing is on the wall, be prepared for the Durbin roll-over in Obama administration. If you are waiting for the green card next year, you was in deep deep very cold water.

USCIS adding up all 140's together and asking companies to prove ability to pay for all candidates together
department of labor auditing just about every eb2 labor
vermont and california service center giving very difficult rfe's to h-1b's - change of employers and extensions (they are actually denying them to)
Consulates sending complaints to department of labor when h-4 goes for visa stamping and they see primary hasn't received paystubs from entry into usa
companies closing down because fines/penalties from department of labor are too much.

I filed I-140 on July 5, and was hoping to get the receipt by this week because as per the press release ( dated 7/13), NSC was supposed to be time complaint with regards to I-140 receipt date by 7/18/2007. But they again changed to 8/1/2007. You never know they will NOT change it again!

Please check with your lawyer but as per my understanding, your wife needs to be in 'status' to be added as a dependent on the 485. Since she is on H1B, she is already in 'status'. There is a separate thread for documents required for 485. Check there.

McCain interview with Judy Judy Woodruff & Richard Stengel, Richard asked something like - what about the green cards for the highly skilled immigrants educated by American Universities. To this Sen. McCain replied implying - they should be given green cards sooner, I am not sure if they could be given automatic green cards but the process should be faster.....
He said it not exactly in these words but implying something to that effect. They were suppose to ask Sen. Obama the exact same questions. Did anyone see Sen. Obama's answer to the question about green card for high skilled immigrants from Richard Stengel? Just curious....

Some people advise to wait and watch and some people ask to do something else. I would like to say one thing and it is purely my perspective. People who are waiting inline for 8-10years does not know when they will be getting their GC in hand. May be in next four to five years. By that time on average their age will be around 35-45.
Do you want to wait 4-5 years and do the job which you were doing 10years back?
Did you had any vision for your career when you started your GC and life?
Do you have the same vision now for your career and life?
Did you feel you and your family have sacrified enough in your personel life for this stupid GC?
IF YOU SAY I HAVE DECIDED TO GO BACK TO MY HOME COUNTRY:
Do you think you will get a managerial job if you go back to india at the age of 40 when you could see guys @30 doing that job with ease and with better experience?
Do you think becos of 10+years of expereince in programming field, indian companies will recruit you for managerial job?
Are you willing to work in India as a programmer with 10+ years of US exp under a 25-30 year old team lead or PM ?
If you say YES , YES , YES for all the above, do you think any indian company will recruit a programmer at the age of 40? forget about the salary you are going to ask for your exp which they will never accept.
So at the end if you wait long enough for GC, then it is better to wait here until you get it. At least you can save your life though you have to start your career from -10years. If you quit and decide to go back to your homecountry, your life is going to be tough.
Options for guys waiting for 8-10years for LC:
1. Try to get PMI Certification, CISA certificaiton.
2. Try to get TOEFL, GMAT scores and keep it ready.
3. Try to get in contacts with most of your friends and manpower agencies in India.
4. If you file for your 485 in next one or one and half years, then proeceed with MBA plans(parttime or full time or executive MBA) in top 25-30 business school.
5. Your waiting will yeild fruit in this country only with MBA as in next 10 years, US will need more managers than programmers to manager all their outsourced projects.
6. If you do not have such vision and you are happy with what you are doing now and if your job is secured for next 100years and if you feel that you will be happy in future by doing the same job and OK with other kids going up the ladder stepping on you and if you are ok reporting to them and listening to them, getting bashed by them etc etc, you can very well wait for next 100 years hoping to get GC one day.
I am not talking about one guy in one corner living beautiful life.
I am not talking about guys who are lucky on everthing to get on time including GC.
I am talking about majority of the people and general human nature, people who came to US with a vision for their career and life. People who have had and has a spark in their eyes.
