    Hello All,

    I received a "Notice of intent to Revoke " on my approved I-140 recently. By gods grace, my company was able to get my I-140 reaffirmed.

    The status on the USCIS website states as follows.

    ".....we mailed a notice to you reaffirming the approval of this case and returned the case to the Department of State for visa processing. For more information, please contact them directly."

    We did NOT request for consular processing. Does any one know why USCIS send my case to Department of State?

    Mine was filed in august 2007. It took 45 days for it to get audited and it has ever since been in process, that is close to 7 months after audit response.

    I had already gotten my USDOS approval and my USCIS approval for my J waiver. The whole process took less than a month which surprised us! But it was stated on the I-797 that I should start working for my employer within 90days from March 19, which will be June 19. The problem is my training program does not end until June 30. Even if I wait until June 19 to file for my H1B, and if I don't go for premium processing, once they approve it and retro-date it, there will be an overlap from June 19-30. Can I apply for the H1 on June 30 instead (when my J expires) but that will be more than 90 days from March 19? I will appreciate any suggestions. Thanks!

    USCIS has updated the H-1B cap count. (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=138b6138f898d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=91919c7755cb9010VgnVCM10000045f3d6a1 RCRD) As of December 8, CIS has received approximately 61,500 cases against the regular (non-Master's) H-1B cap of 65,000. However, since CIS sets aside up to 6,500 of this 65,000 for nationals of Chile and Singapore, it is possible that they will stop accepting other H-1B petitions soon, if not already. We are still filing new petitions, but with fingers crossed that they are not too late. If you need to file, please do so ASAP.
