    I have been on q job with a client since October. The setup is like this. Me->my employer->Vendor-.Client.

    The work order my employer has states that my work with the client ends June end, with a possibility of extension. if i file my h1b now, will i be a good candidate for rejection , considering that I do not have a long term project? Also, how true is it that the USCIS is giving visas out only for 1 year under such circumstances, as opposed to the regular 3 years term, and if true, how do I avoid it

    Lastly, what is your take on how H1 filings on Apr 1 2010 will be? Is it expected to the same as last year, or will companies file left right and center on day 1 itself?

    Hi All,

    Case:EB3
    Priority Date: Sep 2004
    Status: Labor & I-140 approved

    EB2: Labor got approved November 2009.

    I'm trying to file 1-140 amendment with EB3 priority date. Currently i'm thinking of going with Sheela Murthy/Rajiv Khanna,
    could you please suggest some good attorney who can handle my case very well in a limited time? Thanks a lot and really

    Hello All,
    As per the latest regulations, the employer has to pay for all the labor application cost. My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Can they deduct part of my salary to bear the cost etc...?

    Your attorney must have the answer. When you file an I-485, you should include a copy of the I-140 approval or receipt, so your better ask your attorney.

    The New York Times reports that tomorrow Immigration and Customs Enforcement will be sending instructions to agents in field offices aimed at changing their enforcement focus from work site raids that largely resulted in mass arrests of workers to I-9 audits and undercover investigations mainly targeting employers. However, workers will still be subject to arrest.     My wife was working for a company before. They had filed for her GC. She has an approved I140. She had to convert to H4 because of some legal reasons and could not continue to work for the company. Now she has a valid H4.

    She has already been here 7 years on her old H1. Now can she file for a H4-H1 and get a 3 year visa based on an approved 140 ?

    The lawyer says that the 3 year extension rule just states that H can be continued beyond 6 years based on approved 140 and so she can go back to a H1...

    Anyone here has had a similiar experience ?

    Hi! My drivers license has expired which was issued in Indianapolis, and I renewed the drivers license at Indianapolis which I could not get transferred to Florida ( no mail forwarding). Now question is, I want to renew new drivers license from Florida, will there be any problem if I use my old H-1B which was issued at Indianapolis, although I have shifted to Florida in a new job where my old H-1B transfer is till under process? what will the implications of using the old H1B?( I am still getting paid from my old employe)r

    Hi Unitednations,

    Good to see you in Immigration voice. I use to follow your posts when you were back in ImmigrationPortal. I have a request for you here.

    Please provide a ready reckoner on AC21. Like the basics. This would help lot of people trying to switch employers including me. I know there were memos written by Yates and other lawyers. Your real experience on this matter always counts and helps people.

    I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.

    Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
    (2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
    (3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?

    I know I'll lose the GC priority, especially wife's EAD, but I'm debating if it's worth losing my career aspirations? My info: Nov '06 EB2 PD, approved I-140, July 3 I-485 receipt and my present company will file our EAD/APs as long as it is necessary.

    With this mejob workload of I-140 filiing in next 2 months, I-140 procesing times will again retrogress.
    so, can we change jobs even after 6 months of I-485 submission ??
    Is I-140 approval required for AC21
