Hi,
My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?

The time spent in H4 does NOT count towards the 6 year H1 time. So in your case the H1 clock starts from Sep 2004.

I was on F1 visa and applied for my GC / I485 thru my spouse few years back. Unfortunately while coming back from India 3 years back, I used my stamped F1 visa instead of AP. My lawyer told me that due to this, I have abondoned my AOS and he has to withdraw my 485 and refile it when it will be current. Few days back spouse became current and attorney was preparing to apply for 485 again but in USCIS the status of my application was still shown pending not withdrawn. To our surprise, we saw 2 GC in the mail and the online status was shown approved. But the attorney is saying that we should re-file the 485 since USCIS did not withdraw my application and approved it. They says that I might have issues if my absence is detected when I will apply for citizenship later. Please suggest. I am so puzzled and tensed..

My wife came to the US on a H4. She got her H1 approval in October 07 and started working for the consulting firm that sponsered the H1. She also got a consulting position in a company. But her SSN was not issued until Jan 08. So the consulting company cannot gerenate payroll for Oct, Nov and Dec of 2007. We are planning to goto India in May and also get our Visas stamped. Any ideas on whether we will run into problems when we go for stamping, since she will not have a W2 for 07. Also will the paystubs from 2008 suffice at the consulate? Do we have to tell the consulate that she started working in Oct 07 or can we just say she started in Jan 08 will this create a problem of why did she not strat working as soon as her petition was approved in 07.

My reciept notices show the right date in August.

Is there any need to worry or notify any one about this?

This might be little bit old, but I dont remember seeing a post on this. Employment-based immigrant visa fees almost doubled, Old fees $ 355, new fees $ 720 from July 13th. Does this mean USCIS will open the gates in Sept bulletin [to be released in August]?

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Hello,

My I-140 was approved in August 2009 and my PD is Jan-2004 (EB3). I want to know when i can apply for I-485, should i have to wait till my PD becomes Current or is there any other way by which i can file the I-485. Please shed some light on this topic and thanks for your time and effort.

You need to wait for your PD become current...may be in 2019.
