The Great Depression profoundly affected the psyche of the American people, just as today's Great Recession spawns untold emotional harm that will last for generations. Like a toxic seed, the Depression planted itself deeply into the emotional minds of those who lived through it, only to be transmitted from generation to generation, as parents told their children of hardships endured and shame swallowed. I know that it affected me long after my mother shuffled off her mortal coil. As a child, I listened intently to one of her remembrances -- the humiliation she felt in receiving free shoes as a...

I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.
Pls do let me know.

E. APPLICABILITY OF INA SECTION 202(a)(5)(A)AS IT RELATES TO THE ALLOCATION OF “OTHERWISE UNUSED” NUMBERS
INA Section 202(a)(5)(A), added by the American Competitiveness in the 21st Century Act (AC21), provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter then the otherwise unused numbers may be made available without regard to the annual per-country limits. This provision helps to assure that all available Employment preference numbers may be used. In recent years, the application of Section 202(a)(5)(A) has occasionally allowed oversubscribed countries such as China-mainland born and India to utilize large quantities of Employment First and Second preference numbers that would have otherwise gone unused.
If spill over has to happen every quarter as per the detail in above statement, why USCIS is not doing quarterly spill over, it looks like they are still doing annual spill over in to EB2 I and C. My question is am I interpreting the law correctly. Thanks for your help.

Hi,
I am EB3 candidate, with estimate to get GC in 2032. Since Visa recapture bill is not on table. And is part of Immigration Reform Bill (part of reform for illegal people); considering fact that Health Care opposition, election year, 10% unemployment & other unknown factors; I do not see any hope of changing law for employment base (no hope for visa recapture).
Do seniors or admin team see any hope for EB3 candidate?
take care.

Please help me decide.
I have Bsc (3yrs) and MCM(3yrs) (MASTER OF COMPUTER MANAGEMENT) from india .
Degrees evaluation says "UNITED STATES DEGREE EQUIVALENT BACHELOR OF SCIENCE DEGREE IN COMPUTER SCIENCE"
6 yrs + experience prior to joining the current recruiter.
Am I eligible for EB2 category, as my employer says, EB2 be most likely would be rejected/denied and its a big risk
Let me know your inputs.
Thanks
Pramod

Hi All,
I am in EB3 with priority date of 2003 nov, I have a masters degree in US. Because of my negligence I applied in eb3. my i140 is cleared in eb3. waiting for priority date. Now I am planning to file eb2 perm and make us of the old priority date. Before joining for work I completed all the course work but didnt get the degree. I got the degree one year after I joined for work. My graduation date in the degree certificate is 5 months after my priority date. Will this raise red flags in the eb2 I-140 stage. Would it be safer for me to go for regular i-140 or premium processing. Any help or suggestion will be deeply appreciated.
Thanks in advance

Hi
I filed my 485 on June 4th 2007 with NSC. It was transferred to TSC and received my Receipt notice. Now I am going to file my AP.
My question is where should I file my AP?. Do I need to file with NSC or TSC?.
Please someone respond.
Thanks in advance

CIR may be passed but may not give much benefit to high skilled community. This article shows that

The anti-immigration groups seem to be busy with strategic plans to challenge CIR. Hope IV is ready to make a strong case too.

The State Department has released a report showing the increasing number of people with approved immigrant visa petitions at the National Visa Center who are waiting for their visa numbers to be current. The number is about three and one-half million. Given that our immigration laws permit only 376,000 people to immigrate to the U.S. each year under the family-based and employment-based preference systems, the average wait is over ten years long. There are probably another million people residing in the U.S. with approved visa petitions. They are waiting to adjust their status and their numbers are not reflected in...
