Folks,
Pretty soon I'll have to relocate to another city (same job). Wondering if I should continue using my H1B (valid till 2010) or should I use AC-21 to relocate ?
My attorney insists that I use AC-21, and she states that if something goes south during my Adjustment of Status I can re-file for my H1 and she did state the refiling H1 will be exempt from Annual Numerical Limits as I have been on Non-Immigrant visa in the past 6 year and haven't stayed outside the country for over an year.
Is this something I can rely on? Also, what happens to pending AOS(485) if I use this option to refile my H1 from EAD status?

"Has the beneficiary of this petition been previously granted status as an H-1B nonimmigrant in the past 6 years and not left the United States for more than one year after attaining such status?"

yes. its possible. i had my 140 denied and i wanted to know everything about my case from labor to 140denial to appeals. I filed FOIA and USCIS sent me everything on a CD.

Hi all,
Looks like our company is going to merge with another company in the next 2 weeks and the name is going to change ... I am not sure about Tax-id ....
I filed 485 during the July 2007 rush and had I-140 approved in May 2007. I am currently on H1 expiring in Sep 08 .. I sent the papers to the lawyer for extension last week with the current company's documents ... not sure if they applied yet ...
So my questions are:
a) Do I need to do an I-140 Amendment for sure ... (or) can I use AC-21
b) Any risks associated with I-140 Amendment? If something bad happens to the Amendment, Can I still use the priority date (Dec 2006) ...
c) Should I file for H1B Amendment also

My wife is going to India and She has to get her H4 stamped again(I am on H1 and received my next 3 year extension and so did my wife).
My parents are also planing to visit me. Should I book my wife's appointment along with my parent's appointment , or should I book 2 different appointments one for my wife and one for both my parents.

Hi,
I have applied my H1 extension in Sep 2008 and got RFE in Dec. RFE was about my work address and we have sent the details. On March 2 2009 I have received the email saying Denial Notice Sent. Not sure the reason yet. I wanted to check my options. I do have EAD. But not used. What is my visa status now? I am planning to resubmit my application based on the denial notice. I believe working on 1099 is allowed when you have the full time work on H1B going.
There are different types of 1099. 1099-Misc is not allowed. 1099-Int , 1099-G are the examples of allowed 1099s

USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Hi guys,
I got as well the unlucky audit like almost 80% of the people filing for a PERM.
My L1 visa is expiring on May 14th and the PERM audit reply was on Jan 28th and based on the current cases pending, I will hearing back from Atlanta sometimes between July-August.
I also applied for the H1-B and get approved but it is starting on Oct-1st,2008
1.- Can I stay "out-of-status" based on the INA 245 that "allow us to stay up to 180 days because change of status in process"?
2.- This changes of status process is valid only when you file the I-485 or for anyone already starting GC process like PERM in process?
3.- If I need to come back to my country and get the H1-B stamped, Do I loose the current PERM even if it get aproved or can I use the same PERM once aproved and apply for I-140/I-1485 concurrently (because EB-2 category) no matter I 'll have a different Visa H1-B instead of L1-B stated in the PERM?

My I-140 was submitted to USCIS in June, 2006 and got approved in August, 2006 and my employer has received the approval notice. I am checking the case status online but it is still showing up that my case is in pending till date. One of my friends is also in the same situation, his I-140 got approved recently and he received approval notice copy from attroney but the case did not update on the USCIS web site as approved. When I called USCIS, they told me that this needs to be reported by my lawyer and not me. When I talked to my attroney on this, she told me that we don't need to worry about this as the approval notice is available with us. But if the case update showing up correctly, atleast I could show that as a proof for my priority date portability if I switch the employer. Does anyone experienced the same problem and appreciate the suggestion as to how this can be corrected. Thanks in advance.

My wife will be applying for H4 visa (1 st time) some time in march. I am currently working on H1B in US.
while checking the website for documents required for H4, they ask for the Photocopy of the Principal Applicant�s valid visa.
Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
I would appreciate if you could reply me on this regard.

I am using Advance parole in december to visit India. I have applied my canada PR in 2008, but I don't have stamp of PR in my passport.
Is there are any problems using AP for India visit.

And I have to renew my AP, where should I send my AP renewal docs, NSC or NBC?

I have taken a 2 day stop over in Dubai while coming back to USA in April 2010. I booked my flight on Emirates. Emirates will sponsor my visa. But i am not sure now they allow Advance Parole as when i apply for visa one of the requirements says "Travel documents, such as re-entry permits and refugee documents are not permitted"
