Just wanted to find out can you check the below msg that is what mine has been updated to , So does itmean that they just opned the case and are now reviewing and theywill update it to approved once they through or this is final msg. wanted to find out basing on the info you got.

My PD is April 07.
I got two LUDs on June 26th and June 30th out of the blue for my 485....
Not sure why...
I applied for EAD renewal on June 24th though.... but I got LUDs saperately for these two too but on idfferent days

As per member priderock's post the LAY ON THE TABLE description from THOMAS means that the Cantwell AMDT has been killed .

One amendment that has been “filed,” but is not currently “pending” is the Cantwell amendment which is very important to business immigration interests. We do not know at this time what will happen with this amendment – whether it will come to the floor for debate or be negotiated through unanimous consent into the final package.
From AILA's description it would seem that the Amendment is does not have the status "lie on the table" as that would mean that the amendment has been killed with no possibility of coming up but AILA's description as to possible future of the amendment is to the contrary.

chitta123, do not panic. You are in a better situation overall. Find an employer willing to sponsor your H1 and greencard. Start H1 Process (transfer). You will get a new H1- with date of April 2008. Start working as soon as you get a receipt date.
Also start new perm-labor with new employer. apply I-140 with and ask to retain old PD date from employer A -I-140 (Old employer). Since Employer A has laid you off (guessing that they were out of work for you), they cannot and will not benefit from revoking the I-140. Since they cannot use it to hire any other foreigner, since they just layed off.
There might be some other easy way you can do this. Please do not take my views as legal advice. Consult a lawyer (good one) immediately.

Here is news for you. It will not happen. People with ported PDs will take priority as their dates are in 2002, 2002, 2003, 2004, 2005...

As I promised earlier I would keep you guys updated on the process of this case.
On saturday I received the welcome as a permanent resident to USA letter. After trying to get a hold of my attorney I got in touch with him.
Heres the story. (this guy is a genius)
I asked him how it was possible when my PD wasn't current I got GC approval.
His answer was funny and pleasant. Magic :D
He said after the approval of my PERM during filing I-140 under EB2 he also filed a petition under "person with extraordinary ability interest to US" on my behalf. So in other words both the petitions were being processed together at USCIS. Me not aware of USCIS rules wasn't aware of all the lingo so didn't know.
Now the Extraordinary ability petition quota is always current. So when my extraordinary petition was approved the attorney informed the USCIS that to adjucate my adjustment based on this approval. Since the PD was current for this category. USCIS processed and approved the GC based on that. I love this guy I don't have to work for my current employer anymore hence he will get a big surprise when I turn in 2 day resignation. HA...

We should not waste our time and money on this. I also would like to understand the lobbying impact of IV. After hearing tech lobby brought CA governor into picture and even that does not make any difference in favor of tech companies, are we making any impact with 200-300 thousand lobbying and some web faxes?
There is no question about IV effort. But the question I have is impact of that effort.
Per this article..tech lobby seems to had had its impact. Expanded H1B & reducing GC backlog ...before points system takes effect. All this of course if the CIR comes back.

Hi, I have a question about which service center to use when e-filing for AP renewal. Here is my situation:
- I live in California, but my I-485 has been rotting in Texas Service Center.
- When e-filing, one of the questions on the USCIS website was which service center my I-485 application has been pending at. I answered it as Texas Service Center, and went through with rest of the e-filing process.
- After submitting the form, I got the receipt number that starts with "SRC", which I am assuming ties my application with Texas Service Center. The cover letter of the PDF (which was generated right after submission) even said to mail supporting documentation to TSC.
Now, the problem is, I was reading through the instructions for I-131 filing and the PDF (I-131instr.pdf, which I downloaded from USCIS website) says on Page 7 that I should file my AP renewal with Nebraska Service Center, because I am a California resident.
Given that I already filed my AP renewal with Texas Service Center, am I in trouble here? I don't remember the USCIS website asking me or prompting me to file the renewal application with Nebraska Service Center, so I am a bit baffled by how I ended up in this situation. Is there anything I could do to correct it now? Has anyone run into this situation before?

According to thomas this amendment was ordered to "lie on the table". So there isn't much to celebrate:( :( :(

This is a start up company with 15 Million investment and a big venture capital company from NJ is also investing in the company. Would you guys see any potential problems here for H1b sponsorship?

Shows you the general herd mentality on this forum. As long as everyone is thinking the same way, everything is great. If you differ, everyone will call for a ban on you. There are lemmings everywhere. Unfortunately, I had to come to this forum for news. I have never seen such a bunch of dimwitted people at one place...
I generally really like this place but for the past week I have had about 5 moments where I've sat at my computer with complete disbelief at seeing people get banned or yelled at in mass just for being pessimistic or for not agreeing with others' opinions. You'd think it'd be due to cursing, or anti immigrant feelings, or constant spamming/waste of posts, etc, but no, all you have to do is disagree with people. Now who's this guy who inspired the flower movement and what was he about?? right.

Employer B applied for H1B transfer and it was approved in september,2008.But I am still in the payroll of employer A and have not joined B yet(no paystubs etc). Employer A knows this and has not revoked my H1B (visa valid till december 2009 and have got it stamped already). I would like to travel to India in this situation (emergency).
I still intend to work for A after my travel.
1. Will it be a problem at the port of entry with my visa transferred to B,but me still being the payroll of A and intend to continue with A after my travel? (my H1B visa with A is valid till december,2009)
2. What supporting documents do I have to carry with me other than a recent employment confirmation letter,paystubs from employer A?
Currently, I am into the 2nd year of the first 3 years of H1B.I checked with my attorney and she said its ok to come back with the employer A visa.
Please let me know.
