To my knowledge you can leave your employer only after your I-140 has been approved and your I-485 has been pending for 180 days or more. However if your employer is able to continue ur GC as future employee till the I-140 is approved then you could transfer ur H1B to another employer . Plz check with an attorney though.

First congrats to everybody here able to benefit from this great news. For the rest of the road still loooooooong to go. I'm just starting my labor certification process this month and I'm very new to this whole greencard process. Is there any advice I can have to expedite my application before retrogression hits again. Hopefully it will be a little while before CIS brings us to reality of life. Any help to a poor man will be greatly appreciated.

It�s good that at least some of us are getting VISAs, instead of VISAs being lost.
However if this continues we could see a big movement to switch over to EB2 with or without porting PDs. This may in turn help EB3 :)
We need to make this a sticky thread, so that we can brainstorm and put best ways to switch from EB3 to EB2 w/keeping older PDs.

All,
I visited the local office at Waukegan (Chicago suburb) last week to apply for SSN for my wife (H1 & EAD) and my minor son (H4) and was surprised to see SSN card in my mail box today for both of them!! :) (frankly I was expecting to see a denial letter for my son). Sequence of events
Me: submitted SSN form, passport for my minor Son
SSN officer: Upon seeing the visa. We do not accept application for h4 w/o work authorization
Me: I produced the printout of SSN provision 20 C.F.R. � 422.104(a)(3) and informed here that I need to apply for Federal benefit (stimulus package) and for that I would need one
SSN Officer: Oh yea..Oh yea.. there is a provision and she accepted the application
My sons SSN card displays "Not authorized to work".Thanks to Totoro posting the information on 05/03/2008.

Dear All,
My brother completed his Masters in Mechanical Engg in December 2006 and is on OPT till December 2007.
His H1b was filed through a IT consulting firm (Lets say Company B) and is in process and is due by October.
He has now pursued employment in his own field in company B on his OPT.
Company A is cooperative and says they can assist in h1b transfer when the h1b comes through to company B.
The question is, is paystub needed for this kind of transfer? Or Transfer can be done prior H1b start date (ie Oct 1st, 2007) as he is still in OPT?

She is very slow and does not even talk to you. The staff working in thier firm is arrogant. I was current in June but they didn't apply eventhough i sent my papers in May. Instead they were cursing DOL for the July bulletin withdrawl. They'll never respond to emails properly. I strongly don't recomment Jennifer Hallet.

- Strong measures to curb illegal immigration (with/without a fence)
- Amnesty to existing illegals in the country - claiming that the leak (above) has been fixed and that the illegals already in the country should be brought out from the shadows.
- Measures to speed up family based immigration - with papers being processed by the same department that works on EB immigration; slowing down EB processing further.
The only silver lining which people seem to hang on to is a politician's response to the state of highly skilled immigrants. Note that almost no one is against US educated legals from getting GCs and this is what Obama and McCain have been questioned about as far as legal immigration goes - obviously their answer is that they support us. That is a no-brainer. The controversy as far as legal immigration goes has to do with people without a US higher degree and no one really talks about that as far as legal immigration goes. But that doesn't mean the STEM bill will pass - no opposition doesn't mean it will translate to action for a group who has negligible voting power even if we eventually get it.

I think the right way is for it to move laterally. If the govt wants 40,000 EB-1's it should get that number or atleast close to it. No point in some one in EB-1waiting for their GC when it filters down to a lower category. Also no point talking about why everything has to be equal. It is not, thats why they have set EB1,EB2 and EB3.Each requires a different skill set. People would not have raised this issue if this was an EB1-EB2 issue. Only because it is a EB2-EB3 issue there is so much outcry. If they have laterally used EB-1 if there was high demand in EB-1 no body would have raised the issue as they know what skills EB-1 needs. Now that it moved laterally in EB-2 some EB-3's who think they are as qualified as EB-2's is creating all this issue. Again you should have applied in EB2 than EB3 instead of raising questions on why EB2 moved forward.
Also its not like it is current or anything. EB-3 ROW is still better than EB2 India/China and for Christ's sake EB2 India was unavailable last 2 months......

You came here 6 years ago and applied for your GC only in 2010. Didnt you find an employer who would file one for you. And you also know if your GC gets screwed for some reason, then you are out of the US also.
