I need an advice.
Last year, I petitioned for my husband to get his green card and I was in a rush to get the application in before the application fee shot up, so I forgot to make copies of all the documents being sent to USCIS. Now, the interview is next week and I don't have a few of the documents that they want us to bring. It says that if already submitted, I don't have to bring in those documents, but I've heard that sometimes the interviewers still demands them during the interview.
Is there any way of getting the documents from USCIS or is it lost forever?
We will have the interview next Thursday, 21st of February.

Hi,
My sister is a citizen and she applied GC for my parents who are in India.She applied for I-130 in April and it was approved in 2 months.She now has to fill the form I-864 and is in the process of doing so.Meanwhile my parents would like to visit USA.They'll be coming in December and be staying for 6 mos.They have a 10 yr visa and visited us back in 2004.
My question is it ok for them to visit USA?I read that they might be denied entry becasue of their approved I-130.We do not want to apply AOS here and they will return in June 09.
Thanks for any advice.

It seems like ages since the federal government transformed the rules on when and how foreign citizens apply for visas to enter the United States. Actually, the most dramatic changes occurred in the summers of 2003 and 2004. In 2003, the government dramatically restricted the authority of American consular officers to waive the appearance of visa applicants for an in-person interview. United States Citizenship and Immigration Services (USCIS) released an updated H-1B cap count of 45,100 as of August 28, 2009. This reflects an increase of 100 cases from the prior count, provided on August 14, 2009. The advanced-degree cap remains at 20,000. The USCIS continues to accept FY2010 H1B cases under the advanced-degree and regular caps.
We suggest to US employers to file H-1B Petitions only if they can able to provide the Client details like Letter from the end-client, Work-orders confirming the placement. If you are having an in-house requirement, provide USCIS with ample proof of your in-house requirements. Considering the flood of H-1B RFEs, we have to be bit cautious in filing works. The standard approach prevailing until last year needs a re-look. Be assured, if you are right on papers and abide the Immigration requirement, you will for sure come with flying colors. We will be happy to help and support you in H-1B and other filings. It is widely believed that the H-1B Cap will be available even after Sept. 30, 2009.

Nothing unusual...infact just a tiny tip of an iceberg. Family based immigration including marriage constitute close to 85-90% of US new immigrants. Other avenues being tightened in recent years, we are sure to see more and more. In fact in recent years I have seen many H1Bs/F1 marrying USC.
For every case being busted, there are many many undetected cases. It is called legal arbitrage, with other areas being tightened amd under attack and marriage based being relatively untouched, it is a matter of time that one will increase.

I am working on H1b visa and changed job mid of last year. I got my H1B visa and stamping and is valid till September 2010 . Now I changed my job and has another H1b visa and I 94 which is valid till 2012.
I am going to Canada to get Visa stamped and want to know if I will be allowed to come back to US even if my request gets denied.
And what will happen to my old visa ?

While most of the folks are busy working on I485, EAD, AP stuff, does anyone has any information about the h1b filing that would begin in April 2008. Is there any policy program, the govt. is coming out with to let the chaos of April 2007 not happen again?
