Hi,
I have been searching in the inernet for quite some time and looks like
the following questions are still not answered properly. So any of you here who actually used the AC21 in the past can answer the below questions and it will help lot of people on this board.
1) When the employee don't have I-140 receipt number and I-140 approval copy , is it okay to use AC21 after 180 days ?
2) Do we need to have I-140 approval copy for the EAD renewal ?

My attorney sent in EAD renewal applications for me and my spouse. We got a receipt from USCIS yesterday with a MSC receipt number with some information on scheduling biometrics. I called my attorney and asked him about the same. He said that this is normal as he did the right thing by sending our application to a lock box address in Chicago. We are wisconsin residents. Please advise if this is fine to get a recipet notice from the Missouri service center address.

Hello everyone,
I obtained my F1 visa in Aug,2001 for 5 years and I initially came here for M.S. I have continued for PhD in 2003 and visited India every two years. My F1 expired in Jul,2006 but my I-20 is valid until Dec,2008.The real problem is that I have applied for Canadian PR this Oct and expecting to get it by Oct,2008.
Once I get my PR, I have to go to Canada for Visa stamping and my questions are related to this:
1) Since my F1 expired, Can I come back to US after PR stamping, without needing an F1 visa.?
2) Is it advisable to get my F1 visa stamping in India or Canada next year i.e in Oct 2008, or would it be too late? (since that would be two years after visa expiry).
PS: I wanted to get my F1 stamping only if it were necessary to go to India.
Any suggestions would help me a lot and thanks so much in advance.

Could anyone kindly provide guidance>
My wife, daughter and me have different dates on our green card with mine being the earliest. I am now eligible to file the N400 but my wife has 6 months to go. Does she become eligible only then or does she become eligible as my wife now, once I get approved. My daughter being a minor I guess should be fine on my application

This may seem strange and confusing. Here is my case
I changed my employer from A to B with an intention of taking advantage of an existing approved labor with employer B. I applied for I-140 and H1B transfer at the same time in March 2007. I-140 was approved in June 2007. In July 2007, I applied for EAD and 485. Meanwhile, I got an RFE for H1b transfer and my attorney responded to this in time. I got my EAD approval in Sep 2007 and got FP done before my I-94 (thru company A) expiration in Nov 2007. I got a denial notice for my H1B on Nov 13 2007. My attorney missed the appeal date so no appeal has been filed for the H1B denial.
Here are my questions:
- Am I currently out of status since my I-94 expired in Nov 2007?
- If I am not out of status, what is the next course of action I should be taking?
- Will there be any issues when i try to renew my EAD?

I came to US on J1 visa (exchange visitor program) and got waiver and converted to H1 visa. I could not apply for I-140 due to employers problems and now I have short of time for H1 extension.

I took the citizenship test, biometic now the second time .passed it 2 1/2 years ago . I was told the immigration did not have my filed . So Wait. Went to immirgation office 3 times. no result . Case under review ????? what is that mean????? Am confused ... No one can tell me what was going on . I have done no wrong. pay my taxes....

I am in I-485 pending status. Could some one give clarification for the following questions on I-131 doc.
Part I. Information about you
3. Class of admission (is this correct?)

4. Have you ever been issued a reentry pertmit or Refugee Travel document?
I am in AOS status(I-485 pending). I got twice Travel Document (AP) approved so for.
There is no mention of AP in this question. what should I answer for this question.

Hi All,
I fulfill the requirements of AC 21 (485 pending for more then 2 years and I 140 approved long back)
My current project is not my employer's client. There is one middle vendor from which I have got this project.
Now, I have heard that many consulting companies make you sign a contract which states that any client you find becomes their client and therefore forbidding you to join them directly. As we usually dont see papers while signing I am not sure if I did sign any such thing. My question is, if my employer sues me on this clause, does it hamper my I-485 processing? Any input in this context would be highly appreciated.Tension is killing me

I am working in Job A and my GC was filed for Job B by my current employer. It has been more than 180 day since my I-485 is pending. I would really appreciate it, if someone could give me some advice.
Here is my situation, in January 2005, I married my girlfriend, who I had dated for little over a year. She is a US born citizen, so we decided to file for my permanent residency upon marriage. Upon receipt of my Green Card in Jan 2008, I filed for naturalization. Our relationship started heading south last year. We tried counseling and it didn't work out. We finally decided to part our ways amicably in Sep, 2009.
I am 34 years old and for reasons unknown to me, I am showing signs of age. I have been also getting some pressure from my family in India to remarry. Though I do not have any plans to marry immediately, I wasn't sure if my getting naturalized in February 2009 would have any impact on marrying someone from India sometime next year?
Please let me know, if there are any cooling off period required?

I initially voted in favour of this, but on further reflection, I think this is bad policy and urge others to not support this.
Giving I-485 benefits to people without current PDs is a bad idea. It creates a class of immigrants who are neither non-immigrant visa holders (h1b) nor are they lawful permanent residents (i-551) with a set of rights that falls into neither category. The AoS pending status is intended as a short-duration temporary "gap" coverage for people who are a matter of months from having actual I-551 rights.
Essentially, this proposal aims to make every month into the July 2007 fiasco. In addition, and this is the truly horrible part of it, relieves US employers of the pressure and costs they feel now, extending H1Bs every 3 years. That means that the only allies that legal EB immigrants have (US Employers who require their services) are detached from the immigrants themselves...they no longer have a dog in the hunt, and will stop whatever pressure they are bringing to bear now upon Congresscritters and Senators to increase the number of EB visas available.
Disconnecting the interests of foreign-national employees from their US employers will weaken the political position of the foreign-national employees. We cannot vote or contribute to campaigns, our employers however, can do both. If employees are shifted to EADs and APs, with no further involvement of employers in their immigration status needed, then those employers become disconnected from the process, and the one and only ally the legal immigrant has is no longer interested. That's a horrible thing for the immigrant to advocate.
I strongly urge IV to back away from this proposal, as it is not in the long-term interests of the EB Immigrant community. I urge IV to instead focus their resources on items that will help immigrants long term, like increasing the number of EB visas available through initiatives like eliminating the DV program and allocating the visas to EB applicants.
