I don't know if anyone of you has ever gotten on a rush hour train in mumbai. But before leaving for the US, a wise man told me that going to the US is like getting on a train in Mumbai, it's a struggle to get in. You'll have to push, shove, maybe stand on the footboard for a while. But once you get in, hold on tight until you get to your station. That's the philosophy I apply to all of this green card mess. I will hold on tight until my station comes.
My personal opinion is that the US is really not that unfair when it comes to immigrants. All the complaining that we do about unfairness, we do because we hold the US to American standards. We expect justice, effeciency, fairness that is expected of the US of A. We would not even have a chance to complain in most other countries (such as the middle-east, asia and to some extent Europe), because we would quite simply agree that we are always foreigners in those lands, no matter how long we live there, and that our rights as foreigners are limited.
Despite not having a GC, I have never felt like a foreigner here (I grew up in a bunch of countries, so I think I have a a few points of reference). I don't think having a GC will change anything. I can buy property and invest, work as I like, drive a car, speak my mind, pretty much do anything an american can.
We all seem to think GC is a magic bullet that solves all our problems. But in my observation, I have seen people languish in middling careers even after getting a GC, and I have seen people shoot up in their careers, or start successful businesses on H1B. GC might make things easier, but it certainly will not ensure success.
All of us are intelligent, enterprising risk-takers. I say risk-takers because setting up life in a new country is always fraught with risk. And we have taken that path. So we must accept all the ups and downs that come with it.
So my friends, if you're on the train, hang tight till your station comes. If you're planning to jump off mid station make sure you jump off in the direction of the train. :)

Smaller cities also have a hike in prices but nothing comparable. So the average Indian does not really get affected a lot. The average city dweller is either renting by paying a ton of money or is spending a ton of money for a house. Scary thing is either ways they are able to afford it. :D:D:D High rent and High living cost is the effect on average folks
Makes the US salary seem meaningless in comparison(comparing quality of life here and not just money). I am not convinced about this. Actually infrastructure setup in US is way beyond what we can expect in India. That adds to quality of life to great extent.

We cannot start a S-corp on EAD. Need to be GC holder or US Citizen.
The Internal Revenue Code provides that a Corporation filed with any U.S. state shall be taxed under "Subchapter C." This essentially means that all Corporations start out as C-Corporations for tax purposes.
Should a Corporation's owners later wish to be taxed as an S-Corporation, they would file a "Subchapter S" federal tax election (Form 2553) within 75 days of incorporating or within 75 days of the beginning of the calendar year. If they start processing/approve I-140, they will immi get bombarded with I485/EAD/AP applications. So they are trying to artifically stem down the workload they might get. Also this gives them a chance to clearup the 485 queue ... :-)

Every year congress mandates that 140k immigrant visas may be issued. Lets say, in a particular year 200k applications were sent in, but only half of them could reach a stage where they could be approved (rest half are stuck in name check et al). Now you can approve only 100k which means that 40k visas which could have been used will go wasted for that year.
If visa numbers are assigned to cases as soon as the application is entered into the system based on the PD even if there case is not approved that year still they can get the visa whenever there case can be approved so effectively no visas are wasted in any year.

The upper limit should be on a per state basis, at the very least. 150K AGI in CA is not much of a deal. Pretty much all double income families will cross that limit, and quite a few single income ones. Bummer!!:mad:
BTW, you can barely afford a Condo or a low end home in Bay Area for 150k AGI.
I agree with you completely. But note that the amount of rebate starts phasing as your AGI goes north of 150K. I'm in a similar situation and not getting the rebate at all. But the way to approach this is (at least that's how I am consoling myself) "Because we make a lot of money, we are not getting this rebate. Would we prefer to make less money just to get this itsy-bitsy one-time rebate?"*
And anyway rebate-on-a-per-start-basis would be a logistical nightmare for IRS given how competent federal goverment bodies are... ^^^ detect heavy dose of sarcasm here ^^^
Don't even think of proposing that idea to IRS. The next thing you know, these rebates will be backlogged. And in 2012, there will be a TaxRebateVoice.com suggesting administrative fixes/law changes to get the 2007 rebate! :D

We have some good synergy amongst or members in So Cal, lets plan a meeting in the coming weeks and decide on an action plan. I would encourage you to start thinking about ideas/specific actions we can take. I have a few ideas and would share it on our so cal email distribution list. people ahead of me. so about 14 years of wait assuming
3k EB3 GCs for india per year.
by that my daughter will be old enough to file my family based GC

I have been reading your suggestions about visiting DC and/or organizing flower campaign. They are good suggestions and I really liked the flower campaign when it was first done in 2007. But I think, repeating it and sending bunches of flowers to the offices of senators would not influence them as much.
Instead I think, if we can all send some donations to a charity which each of these senators is associated to, it would help the charities and might also influence the senators/congressman more. This will also serve as a reminder about the positive contributions of the immigrant community to this country.
I would welcome suggestions from other experienced members on how this can be implemented. But my initial thoughts are, we identify the senators/congressman(woman) we want to contact, select a local charity, or a charity to which these people are associated with, and send in checks of 5 or 10 dollars per person to each of these charities.
Even if each of us is willing to contribute $100, we might be able to reach 10-20 of these lawmakers. And there is nothing we are losing here even if the lawmaker turns a blind eye to our cause. The money will be used for charity and so it serves some purpose.
And along with the donations, we can request them to support the Visa Recapture Bill, which will help all of us.
And my EB2 friends, we need your help also, as you never know how these dates can change in the coming months. Nothing is done and over untill you get the physical card. Dont mean to dampen your spirits, but you and I know what the truth is.

Dear Friends,
I applied for my AP with a RD of Dec.8, 2007, during the last 3 days I am noticing change in LUD , including yesterday (02/18). One surprising data I found was even there is a LUD on my previously approved AP.
